Terms of Service

Welcome to Justlabs. These Terms of Service ("Terms") govern your access to and use of the Justlabs website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. About Our Services

Justlabs provides an online platform that enables users to order laboratory tests, which are performed by Quest Diagnostics and other certified laboratories. We facilitate the ordering process, provide access to your results, and offer tools to help you understand your health.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a resident of a state where our Services are available
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Ordering and Payment

Test Orders

When you place an order, you authorize a licensed physician in our network to order the requested lab tests on your behalf. You acknowledge that:

• Certain tests may require fasting or other preparation
• Some tests may not be available in all locations
• Test availability and pricing are subject to change
• You must visit a Quest Diagnostics patient service center to complete testing

Payment

Payment is due at the time of order. We accept major credit cards and process payments securely through Stripe. All prices are in US dollars. You agree that:

• You are authorized to use the payment method provided
• Prices may change without notice before an order is placed
• You are responsible for any applicable taxes

Refunds

You may cancel an unused order and receive a refund within 21 days of purchase. If you have visited a Quest Diagnostics lab and had the specimen collected, the order cannot be refunded.

The refund will be equal to the price of the order less a $15 cancellation fee.

To cancel your order and receive a refund, please email us at support@justlabs.health. Include the order date and the name on the order. It will take us 24-72 hours to process your request.

You will receive your refund back on your card 5-10 business days after we issue it. The exact time depends on the bank that issued the credit card.

5. Lab Results

Lab results are typically available within 1-3 business days, though some tests may take longer. Results are provided through your secure online account. You acknowledge that:

• Results may contain values outside normal ranges
• Abnormal results do not necessarily indicate disease
• Results should be reviewed with a healthcare provider
• We may be required to report certain results to public health authorities

6. HIPAA and Privacy

Your health information is protected under the Health Insurance Portability and Accountability Act (HIPAA). By using our Services, you acknowledge receipt of our Notice of Privacy Practices. We act as a Business Associate to the ordering physician and maintain appropriate safeguards for your protected health information.

7. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose
• Impersonate another person or provide false information
• Order tests for anyone other than yourself without authorization
• Attempt to access another user's account or data
• Interfere with or disrupt the Services
• Circumvent any security measures
• Use automated systems to access the Services
• Resell or commercially exploit our Services

8. Intellectual Property

All content, features, and functionality of our Services, including text, graphics, logos, and software, are owned by Justlabs or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers

We do not guarantee the accuracy of lab results, which are provided by third-party laboratories. Laboratory testing has inherent limitations, and results may be affected by factors outside our control.

10. Limitation of Liability

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Justlabs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately, though provisions that by their nature should survive will remain in effect.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Justlabs regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent.
